1.
Scope: This Acceptable Use Policy governs the usage
of GeckoHost products and services. This policy is incorporated
by reference into each contract GeckoHost enters into with
a customer for the use of such services.GeckoHost reserves
the right to modify this Policy at any time without notice.
2.
Purpose: The purpose of this policy is to enhance
the quality of services and to protect GeckoHost's customers
from illegal, irresponsible, or disruptive Internet activities.
3.
Prohibited Uses: Users may not:
a.
Utilize the service to send mass unsolicited e-mail to third
parties.
b. Utilize the service in connection with any
illegal activity. Users may not:
i. Utilize the service to copy
material from third parties without proper authorization;
ii. Utilize the service to misappropriate
or infringe the patents, copyrights,
trademarks
or other intellectual property rights of any third party;
iii. Utilize the service to
traffic in illegal drugs, illegal gambling, obscene materials
or other
products or services that are prohibited under applicable
law;
iv. Utilize the service in any
manner that violates applicable law.
c. Utilize the service in connection with any
tortious or actionable activity. Users may not:
i. Utilize the service to publish
or disseminate informaiton that (A) constitutes slander,
libel or defamation,
(B) publicizes the personal information or likeness of a person
without that person's
consent or (C) otherwise violate the privacy rights of any
person.
ii. Utilize the service to threaten
persons with bodily harm, to make harassing
or abusive statements
or messages, or to solicit the performance of acts or
servicse that are
illegal under applicable law.
d. Utilize the service in connection with any
other disruptive or abusive activity.
Users may not:
i. Utilize the service
to undermine or cause harm to a server or customer of GeckoHost;
ii. Use programs that
consume excessive CPU time or storage space;
iii. Allow the use of
mail services, mail forwarding capabilities, or autoresponders
other
than for the customer's own account;
iv. Resell disk space
without an appropriate reseller agreement;
v. Resell or provide remote
access to CGI scripts installed on GeckoHost servers;
vi. Operate IRC servers
or IRC bots from GeckoHost servers.
4.
Account Policies and Cancellations:
Cancellation requests can be submitted via our ticketing system
at http://support.geckohost.com. Although no notice is required,
and there is no cancellation fee, all fees paid for service
up to the notice of cancellation are non-refundable. If cancellation
is made within the first 30 days of service, all hosting fees
will be refunded. This does not include fees for domain registration.
Accounts are payable in full at the time the account is created.
If payment by check or money order is selected, payment must
be received within two (2) weeks of account activation or
the account will be suspended without further notice to the
customer. New accounts that remain past due for thirty (30)
days after account activation are subject to termination.
Any account reaching thirty (30) days past due is subject
to suspension for nonpayment. Such accounts are subject to
termination after forty-five (45) days in the past due state.
5.
Suspension:
Activity which results in a suspension or deactivation of
an account will result in a forfeiture of fees paid. Complaints
made regarding abuses of an account will be grounds for suspension.
6.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service
at our sole discretion.
All sub-networks,
distributive hosting sites, and dedicated servers of GeckoHost
must adhere to the above policies. Please direct any violations
of the above policies to abuse@geckohost.com.
Failure
to follow any terms or conditions will be grounds for immediate
account deactivation.
7.
Reservation of Rights:
GeckoHost reserves the right to cooperate with appropriate
legal authorities in investigations of claims of illegal activity
involving GeckoHost's services, customers and other users.
GeckoHost reserves all other rights to respond to violations
of this policy to the extent of applicable law and in accordance
with any applicable contractual obligations. |
